NBN Co SAU variation: extension to non-price terms Communications Access undertaking

On 8 May 2019, NBN Co lodged a proposed variation to its Special Access Undertaking (SAU) with the ACCC. The Competition and Consumer Act 2010 (CCA) allows NBN Co to give the ACCC a variation to an SAU already in operation. The ACCC accepted NBN Co’s current SAU on 13 December 2013, following an extensive consultation process.

The purpose of NBN Co’s SAU variation is to extend the expiration date of three non-price provisions set to expire 30 June 2019 to the end of the Initial Regulatory Period, which ends on 30 June 2023.

On 28 March 2019, T-Ports provided a written application to the ACCC seeking to be determined an exempt service provider of port terminal services provided by means of its port terminal facility, which is currently being developed at Lucky Bay on South Australia’s Eyre Peninsula.

On 12 December 2018, the ACCC consented to ARTC's application to vary its 2008 Interstate Access Undertaking to extend the term to 28 February 2019.

ACCC assessment of internet interconnection arrangements Communications Update Finalised

Internet interconnection refers to the arrangements individual networks make with other networks to exchange internet traffic. To access content on (or originating from) another service provider’s network, an internet service provider must interconnect directly or indirectly (via a third party network) with that service provider. The two types of commercial models for internet interconnection are transit and peering.

Copyright Guidelines 2019 Communications Guideline Finalised

The ACCC released draft guidelines for consultation in 2006, but did not proceed to finalise these guidelines as it considered that its participation in Copyright Tribunal proceedings would both test its new role under the Copyright Act and further inform the development of the guidelines. The ACCC considers it is now an opportune time to revise the draft Copyright Guidelines and move towards issuing final guidelines.
