Fixed line services

Under the Competition and Consumer Act 2010 (the Act), the ACCC is able to declare and make final access determinations for listed carriage services if it considers it is in the long term interests of end users for it to do so. The ACCC regulates seven fixed line services.

The ACCC released its final indicative prices in November 2006. The indicative prices relate to the 2006 and 2007 calendar years.

In December 2005 Telstra submitted two unconditioned local loop service (ULLS) undertakings. The undertakings set out how Telstra proposed to meet its standard access obligations to supply the ULLS for the period from 1 January 2006 to 30 June 2007 and from 1 July 2007 to 30 June 2008 respectively.

The undertakings related to the monthly charge Telstra proposed to charge for the ULLS.

The ACCC released Telstra's undertakings on 16 January 2006.

The ACCC released its final decision to reject the undertakings in August 2006.

2002

The ACCC declared the unconditioned local loop service (ULLS) in July 1999. In response to a discussion paper, submissions were received from several interested parties and these views were taken into account in developing the final report released in April 2002.

On 11 July 2013, the Australian Competition and Consumer Commission (ACCC) commenced a combined public inquiry into the declaration of the fixed line services.

In July 2002 the ACCC granted two separate exemptions in response to an application from Telstra for exemption from its obligations to supply the local carriage service to its competitors in CBD areas of Melbourne, Sydney, Brisbance, Adelaide and Perth.

On 22 February 2012, the ACCC made a decision to declare a layer 2 bitstream service, to be called the local bitstream access service (LBAS).

Telstra - Line sharing service undertaking 2003 Communications Access undertaking Finalised
2004

In September 2003 Telstra lodged an access undertaking with the ACCC specifying the terms and conditions upon which it undertakes to meet its standard access obligations to supply the line sharing service (LSS). The terms and conditions primarily relate to the pricing of the LSS and not to other matters of supply. The undertakings include service descriptions and a price list specifying Telstra’s proposed charges for the service outlined in the service description.

The ACCC released a discussion paper on Telstra's access undertaking for the LSS in December 2003.

2005

On 15 July 2009, the ACCC issued a final decision to extend the declaration of each of the six fixed-line services for a period of five years until 31 July 2014.

The exemptions provisions relating to the WLR, LCS and PSTN OA services have been removed from the relevant final access determinations as of 17 December 2011. The exemptions no longer apply in any Exchange Service Areas.

On 16 December 2011 the ACCC commenced an inquiry into declaration of wholesale ADSL services under section 152AL of the Competition and Consumer Act 2010 (the Act).

The ACCC issued a discussion paper inviting submissions on whether declaration of wholesale ADSL services would promote the long-term interests of end-users.

On 14 February 2012 the ACCC decided to declare the wholesale ADSL service under section 152AL(3) of the Act.

The undertaking sets out how Telstra proposed to meet its standard access obligations to supply PSTN OTA and the LCS from 1 July 2006 to 30 June 2008.

On 3 October 2012, the ACCC made a final access determination (FAD) for the LBAS. A copy of the LBAS FAD is available on the public register of access determinations.

Following consultation and analysis the undertaking was rejected and a final report outlining the decision was issued in July 2000.
